Subject: 9869 Small Animal Kennels, etc. Date: Tue, 24 Apr 1990 11:55:00 -0500 ORDINANCE NO. 9869 AN ORDINANCE TO AMEND ARTICLE V, SECTIONS 604 AND 504 AND ARTICLE VIII, SECTION 107, OF THE CHATTANOOGA ZONING ORDINANCE TO PROVIDE REGULATIONS FOR THE LOCATION OF SMALL ANIMAL KENNELS, BOARDING OR TRAINING FACILITIES AND SIMILAR USES. __________________________ WHEREAS, the Building Department of the City of Chattanooga has requested that the Chattanooga Zoning Ordinance be amended to provide regulations for the location of small animal kennels, boarding facilities and similar uses; and WHEREAS, the Chattanooga-Hamilton County Regional Planning Commission has reviewed the proposed amendment and recommended same to the City Council of the City of Chattanooga; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That the Chattanooga Zoning Ordinance be and the same is hereby amended as follows: SECTION 1. That Article V, Section 604, be amended by adding a new subsection (7) as follows: 0C (7) Small animal kennels, boarding or training facilities and similar uses. SECTION 2. That Article V, Section 504, be amended by adding a new subsection (D) as follows: (D) Small animal kennels, boarding or training facilities and similar uses. SECTION 3. That Article VIII, Section 107, be amended by adding a new subsection (19) as follows: (19) For small animal kennels, boarding or training facilities and similar uses in the C-1 Highway Commercial Zone and C-2 Convenience Commercial Zone, subject to the provision that any outdoor use: (a) Shall be limited to the rear yard and (b) Shall be 50 feet from any residential, commercial, or office use or zone and (c) Shall be fenced by a sight-obscuring screen (either solid or veil block, or some form of fence that is at least 50% opaque and at least six (6) feet high). No chain link, slat or wire fences can be used to meet the requirements of this section. 0C BE IT FURTHER ORDAINED, that this Ordinance shall take effect two weeks from and after its passage as required by law.
